These Terms and Conditions (“Terms”) govern your access to and use of our website (lingucanada.ca) and the translation services we provide (“Services”). By accessing or using our website or Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

   1. Scope of Services

1.1. Lingu Canada Inc. provides translation services, including but not limited to:

- Certified

- Official

- Academic

- Professional translations.
1.2. We do not provide legal, immigration, financial, or other professional advisory services, and nothing on this website shall be construed as such advice. 
1.3. Any translation provided is limited to the faithful conversion of content between languages and does not constitute validation of the accuracy, legality, or authenticity of the original document.

   2. User Responsibilities

2.1. By engaging our Services, you represent and warrant that:

• The information and documents you submit are complete, accurate, genuine, and unaltered.

• You have the legal right to request translation of the submitted material.

• You will not use our Services for any unlawful or fraudulent purpose.

2.2. You remain solely responsible for verifying with third parties (such as government bodies, educational institutions, or employers) whether translations provided by us will be accepted for your intended purpose.

   3. Document Submission and Acceptance

3.1. We reserve the right to refuse, decline, or cancel any translation request at our sole discretion if:

• The document is illegible, incomplete, altered, fraudulent, or otherwise unsuitable for translation.

• The content is unlawful, defamatory, or reasonably deemed offensive.

• We believe fulfillment of the request would breach applicable laws, regulations, or professional standards.

3.2. In such cases, if work has not begun, a refund may be issued in accordance with our Refund Policy (available at the link in our website footer).

   4. Certification and Limitations

4.1. Where applicable, translations may be certified by a qualified translator. Certification is limited to attesting that the translation is accurate and complete to the best of the translator’s knowledge.
4.2. Certification does not guarantee that a translation will be accepted by a third party, authority, or institution. We are not responsible for the decisions, requirements, or processing timelines of third parties.

   5. Intellectual Property

5.1. All website content, including but not limited to text, images, design elements, graphics, logos, and underlying source code, is the intellectual property of Lingu Canada Inc. unless otherwise noted.
5.2. You may not reproduce, copy, modify, distribute, or exploit any portion of the website content without our prior written consent, except as permitted under applicable copyright law.

5.3. Document Retention

We retain translations, original documents, related communications, and associated data for a minimum of 2 (Two) years to support record-keeping, quality assurance, and legal compliance. After this period, records may be securely deleted unless longer retention is required by law, regulatory obligations, or legitimate business needs. By using our Services, you consent to this retention policy. You may request deletion of your records, subject to applicable legal and regulatory requirements.

 

   6. Communications and Notifications

6.1. By contacting us through this website or other channels, you consent to receive communications related to your requests, including confirmations, updates, and responses.
6.2. You may also receive promotional or marketing communications, from which you may opt out at any time by following the instructions provided in such communications.

8.2. Our total aggregate liability for any claim shall not exceed the amount actually paid by you for the Service giving rise to such claim.
8.3. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law (including liability for fraud, willful misconduct, or gross negligence).

You agree to indemnify, defend, and hold harmless Lingu Canada Inc., its directors, employees, contractors, and affiliates against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from your:

• Breach of these Terms,

• Violation of any applicable law or third-party rights.

To the extend permitted by law.

   10. Governing Law and Jurisdiction

10.1. These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
10.2. Any dispute, controversy, or claim arising under or in connection with these Terms shall be submitted exclusively to the courts of the Province of British Columbia, located in Abbotsford, Canada.
10.3. You expressly waive any objection to jurisdiction or venue of such courts.

   11. Modifications and Updates

11.1. We reserve the right to update or modify these Terms at any time without prior notice.
11.2. Any changes will be effective immediately upon posting on this website. Continued use of our website or Services after changes are posted constitutes your acceptance of the revised Terms.
